Terms of Service

1. Acceptance and eligibility

These Terms of Service (“Terms”) form a binding agreement between you and TRENDE LLC for your use of the Trendee website, application, integrations and related services (together, the “Service”). You accept these Terms by registering, logging in, purchasing a subscription or otherwise using the Service.

You must be legally able to enter into this agreement. If you use the Service on behalf of a company or other organisation, you confirm that you have authority to bind that organisation and that “you” includes that organisation.

If you do not agree to these Terms, do not use the Service.

2. The Service

Trendee is a cloud-based tool for discovering and analysing publicly available short-form content and for creating content ideas, transcripts, translations, scripts, analytics and other materials with artificial intelligence technologies.

The available features, limits, token consumption, plans and prices are displayed in the Service interface. We may improve, modify, replace or discontinue features where reasonably necessary for security, technical, legal or business reasons.

3. Accounts and security

You must provide accurate and current account information and keep your login credentials confidential. You are responsible for activity under your account, unless you have notified us promptly of unauthorised use.

Do not sell, transfer, share or make your account available to another person without our written permission. You may request deletion of your account through the Service or by contacting us.

4. Licence and intellectual property

Subject to these Terms and payment of applicable fees, TRENDE LLC grants you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose during your subscription period.

Trendee, its software, interfaces, databases, design and branding are protected by intellectual-property laws and remain the property of TRENDE LLC or its licensors. These Terms do not transfer ownership of the Service to you.

You retain rights in materials you lawfully provide to the Service. As between you and TRENDE LLC, you may use the output generated for you by the Service, subject to these Terms, third-party rights and applicable law. AI-generated output may not be unique, accurate or suitable for your intended purpose.

5. Acceptable use

You must use the Service lawfully and responsibly. In particular, you must not:

• violate applicable law, another person’s privacy, intellectual-property rights or contractual rights;
• upload, request, create or distribute unlawful, infringing, deceptive, harmful or abusive material;
• use the Service to bypass access controls, scrape protected data, create fake accounts, interfere with a third-party platform or breach its terms;
• reverse engineer, copy, resell, rent, sublicense, disrupt or attempt to gain unauthorised access to the Service;
• use automated means to access the Service except through permitted interfaces; or
• misrepresent AI output as independently verified fact, professional advice or human-created content where doing so would be misleading.

6. AI outputs and third-party platforms

The Service may analyse information that is publicly available on third-party platforms or direct you to the original source by link. Content on those platforms belongs to its respective owners. TRENDE LLC does not claim ownership of third-party content and does not grant you any rights in it.

You are solely responsible for the prompts, links, data and materials you submit, and for reviewing and using any generated result. You must obtain any permissions required for your use of third-party content. Third-party platforms, providers and integrations operate under their own terms, policies and availability; we are not responsible for them.

7. Subscriptions and payments

Paid features are supplied under a subscription or token-based plan. The applicable commercial terms, payment rules and refund process are set out in the Subscription & Licence Offer and in the Service interface. By purchasing a plan, you agree to pay the displayed fees and applicable taxes.

8. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”. We do not guarantee uninterrupted availability, error-free operation, a particular result, the accuracy or completeness of analytics, third-party content or AI output, or fitness for a particular purpose.

You are responsible for your decisions and for any publication or other use of the Service and its outputs. To the maximum extent permitted by law, TRENDE LLC is not liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, reputational harm or third-party claims arising from your use of, or inability to use, the Service.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

9. Suspension and termination

We may suspend or terminate access if we reasonably believe that you have breached these Terms, created a security or legal risk, failed to pay due fees, or used the Service in a way that may harm Trendee, users or third parties. We will use reasonable efforts to give notice where practicable.

You may stop using the Service at any time. Termination does not affect fees already due or provisions which by their nature should survive, including intellectual-property, disclaimer, liability and governing-law provisions.

10. Changes, governing law and contacts

We may update these Terms from time to time. The updated version becomes effective when published on the Service or on this page, unless a later date is stated. Continued use after the effective date means that you accept the updated Terms.

These Terms are governed by the laws of the Republic of Uzbekistan, without regard to conflict-of-law rules. Any dispute that cannot be resolved amicably will be submitted to the competent courts of the Republic of Uzbekistan, unless mandatory law requires otherwise.
